A DEBT COLLECTION COMPANY THAT MAY SECRETLY TRAIN AND ENCOURAGE ITS EMPLOYEES TO

VIOLATE THE FDCPA 

 

Because of a confidentiality clause in a recent settlement, we cannot disclose the name of the debt collection company this report is about:

It is believed that a debt collection company has a segment in its training program wherein employees are trained to use false names, to raise their voices, and to totally disregard the FDCPA.

Here are a few tactics encouraged in this training program:

-       threaten to lien somone’s property;

-       garnish wages;

-       pretend to be calling from a “legal department” or clerk’s office”;

-       to stop legal action, you “must” give me your banking information;

-       to make up “case numbers” for non-existent lawsuits;

-       to harass, make fun off, and beat down consumers until they pay.

All of the above strategies were used by this debt collector on a Pennsylvania consumer, in order to try and collect money that she was in fact disputing. 

In this instance, the consumer believes that she does not owe the original credit card debt.  The consumer had filed numerous disputes in connection with this debt. However, even if the consumer owed the original debt, the efforts to collect the money are in total violation and disregard of the FDCPA. 

When the debt collector called the consumer in attempt to collect this debt, they made it sound like they were calling from “legal” and had stated on numerous occasions that the “next” step was going to be a Summons and that he was through dealing with her.

The debt collector made fun of the consumer by laughing at her, telling her to ask her mommy or grandma for the money, and accusing her of playing games.

The consumer at one time even asked the debt collector to stop speaking to her in a harassing tone.  The collector replied by stating he wasn’t in customer service so it didn’t matter how he spoke to her.

Throughout the various phone calls, the debt collector continuously asked for banking information.  Which was the collector’s whole reason for harassing and continuously threatening her with a lawsuit.  

At one point, the consumer did give her banking information.  However, this consumer was lucky enough to stop any payments from going through.  Other consumers are not so lucky.

Please do NOT EVER GIVE OUT BANKING INFORMATION Do NOT EVER PAY FOR A DEBT THAT YOU DO NOT BELIEVE YOU OWE, OR THAT YOU DO NOT BELIEVE IS YOURS!
