A Pennsylvania Consumer resolves harassment lawsuit against Midpoint Resolution Group

A Venango County man (let’s just call him Michael) retained Jeff to sue Midpoint Resolution Group.  According to Michael, the facts alleged in the lawsuit are as follows.

Michael went into default on a credit card a few years ago after he was laid off from his job.   Like many, Michael was a hard worker and wanted to try and make good on his bad debt.  He made payment arrangements with the debt collection company, Midpoint Resolution Group, which had been contacting him by telephone.

 

The payments were automatically withdrawn from his checking account every month.  Michael requested verification and documentation of his account activity.  Despite repeated requests, Michael never received anything in the mail from the debt collector.    Therefore, Michael decided it would be in his best interest to stop the monthly automatic withdrawals from his checking account.

 

After Midpoint stopped receiving payments, Michael started receiving harassing phone calls.  Midpoint threatened Michael with a lawsuit.  But even worse, the debt collector threatened to take his drivers’ license away.  Being that Michael drives for a living, this threatened his ability to work.   Michael started thinking about what he would have to do and where he would live if he couldn’t make his rent payments.  What Michael didn’t know at the time was Midpoint could not take his drivers’ license.   The statement was false and violated the Fair Debt Collection Practice Act. 

 

Midpoint wasn’t done.  Midpoint disclosed the debt to Michael’s ex-wife even though she had nothing to do with the credit card account.   

 

When Michael tried to reason with the debt collector, he was called a welfare bum.   The debt collector then placed him on hold to “pretend” he was speaking with an attorney.  This so-called “attorney” said that Michael could go to jail if the debt wasn’t paid.  The debt collector went so far as to say he had access to Michael’s IRS records. 

 

Prior to contacting Jeff, these illegal collection activities made Michael feel scared, stressed out, frustrated, and humiliated.  Midpoint Resolution illegally threatened Michael with jail time, and made him believe they could revoke his driving privilege.  Not to mention Midpoint’s unjustified and abusive invasions of privacy!  Don’t let this happen to you too.  If you are receiving phone calls from Midpoint Resolution Group or any other debt collection company, call Jeff.
