A lawsuit against one of the Credit Reporting Agencies was filed in the Western District of Pennsylvania last year. I am unable to disclose which agency because of a confidentiality agreement with the company. However, it would obviously be either TransUnion, Equifax, or Experian.
The complaint was filed against the agency for violations of the Fair Credit Reporting Act. Simply, the agency was reporting false information on this individual's credit report and failing to conduct proper investigation of this information once disputed. This false information was a civil judgment for over $13,0000. This incorrect information was very devastating to her credit score and became very problematic when she attempted to obtain credit.
The consumer attempted to dispute the debt on numerous occasions. However, each time, the credit reporting agency investigated and "verified" the debt. As a result of the agency failing to investigate this judgment properly, the consumer lost opportunity to obtain credit and incurred extra expenses when finally obtaining credit. Not to mention the embarrassment, humiliation, and frustration one experiences in a situation such as this.
Under the FCRA, a consumer could be entitled to punitive, actual and statutory damages. We were able to settle this case for a very reasonable monetary amount along with the removal of this incorrect information on her credit report.
